Program Participation

1. Eligibility

By participating in the Lumerity Capital, you acknowledge that you meet the clinical criteria established by your healthcare provider for participation. You understand that failure to meet the clinical criteria does not relieve you of responsibility for paying the Diagnosis Online Visit and any required laboratory tests, which are separate from the Membership Fee.

Governing Law and Dispute Resolution

1. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles.

2. Arbitration

Any dispute between you and Lumert Capital will be resolved through binding arbitration, except for claims related to intellectual property or urgent injunctive relief. Arbitration will occur in New York, New York, and will follow the rules of the American Arbitration Association.

Privacy and Data Security

Lumerity Capital is committed to protecting your privacy and maintaining the confidentiality of your medical information. All data collected will be handled according to our Privacy Policy.

Assignment

You may not assign your rights under these Terms. Lumerity Capital may transfer its rights and obligations to third parties without notice in the event of a merger, sale, or other business transaction.

Severability

If any part of these Terms is found to be invalid or unenforceable, the rest of the Terms will remain in effect.
